At the moment of booking with RAICES ANDINAS, “the participant” is subject to the following conditions:

1. Health.

a. All participants are expected to be certain of their health before the departure and are able to complete the trip and have to confirm that they are considered healthy enough to undertake the journey.

b. Before leaving, any participant with an existing or pre-existing medical condition, with any illness or disability or under medical treatment, must inform RAICES ANDINAS as soon as possible. RAICES ANDINAS reserves the right to cancel the contract if the information given by the participant may compromise the integrity of their health. Failure to report the health status as a whole constitutes a violation of these Terms and Conditions and (subject to paragraph 4 below) RAICES ANDINAS shall not be liable for any illness or injury of any participant when caused by omitting the information in due time. RAICES ANDINAS reserves the right to request any participant to leave the tour without right to restitution if the information provided by the participant has been misleading, inaccurate or incomplete.

c. RAICES ANDINAS is not responsible for any illness, serious or temporary, contracted during the trip or any error in the fulfillment of the advice and warnings given to the participant before the trip, for example, but not limited, malaria, hepatitis or AIDS. All informations provided by RAICES ANDINAS in relation to health care is given in good faith and can only constitute an overview of the health risks and the requirements for the expedition. It should be noted that this information is not intended to replace medical advice.

d. Once the trip has begun, ANDREAS RAICES reserves the right to suspend the trip for healthy reasons that affect a participant; similar situation in the activities of physical exercise to be scheduled (biking, trekking, among others). All participants should take the necessary vaccines and medications within a reasonable period before departure and during the expedition (as appropriate) and should consult their primary care physician as to which vaccines and medications they need, as well as seek advice for the itinerary. RAICES ANDINAS reserves the right to inspect the vaccination book of any participant at any time and to cancel any request in case the participant in question has not received all the necessary vaccines or medicines.

e. It is the participant’s responsibility to seek medical advice about all matters of interest to the participant. All participants should be aware that the general health, safety and hygiene standards in the countries to be visited are not up to Western standards, as well as the risk of injuries, fatigue and diseases inherent in the journey to be carried out in Bolivia.

2. Travel documents.

It is the responsibility of the participant to comply with the necessary documentation for visas, passport and other necessary travel documents and RAICES ANDINAS is not responsible in the event that any participant has not made the corresponding arrangements. All information provided by RAICES ANDINAS regarding travel documentation is given in good faith but without liability on the part of RAICES ANDINAS.

3. Travel expenses and cancellation insurance.

a. All participants must be adequately protected by insurance covering all aspects of the trip. RAICES ANDINAS reserves the right to inspect the policy acquired by the participants and cancel any reservation if it considers that the policy in question is insufficient or defective. It is suggested to hire an insurance policy against theft, loss of luggage, plunder, illness, repatriation and accidents.

b. Notwithstanding the provisions of paragraph 3 a), RAICES ANDINAS does not question the suitability of any insurance policy and will not be liable in the event that the insurance policy contracted by the participant is insufficient or defective.

4. Responsibility of RAICES ANDINAS.

a. All participation is accepted on the understanding that the trip may involve some risk and that such risk is considered by the participants including the possibility of injury, illness, discomfort, delays and loss or damage of property. All participants agree to take part in travel at their own risk. Consequently, RAICES ANDINAS is not responsible for any damage or loss that in the following cases:
– Attributable to any action or behavior of the participant.
– Attributable to third parties not related to the functions developed by RAICES ANDINAS.
– Due to circumstances beyond the control of RAICES ANDINAS, including (but not limited to) the circumstances listed in paragraph 6 (a) below.

b. RAICES ANDINAS will only be responsible in all other cases, to the extent required by Bolivian law.

5. Responsibility of the participants.

a. RAICES ANDINAS does its best to advise participants on personal safety issues and to ensure adequate supervision in each of the activities to be carried out during the expedition. However, participants must behave and act at all times responsibly and diligently with respect to their own safety and well-being, as well as that of others. You should also be aware that any injury or damage caused by your own actions, by negligence or by not following the instructions given by the personnel, will be your responsibility and will be subject to the law.

b. All participants are expected to respect and obey the laws and customs of the countries visited during the expedition, as well as the rules and regulations endowed by the staff of RAICES ANDINAS, the institutions or companies with which it works or by any other person or entity in a position of responsibility.

c. The decision of RAICES ANDINAS, its employees and agents regarding any issue related to the expedition is final and all instructions issued by them must be obeyed by each participant in a timely manner.

6. Flexibility / Alterations / Cancellation by RAICES ANDINAS.

a. The participant accepts, understands and recognizes that, given the nature of the trip and the places where the expedition is carried out, a flexible approach is required, allowing the possibility to carry out, if necessary, some arrangements. The program, as it appears in the travel itinerary, should be taken as an indication of what the tour should include, but not as a contractual obligation to be fulfilled to the letter by RAICES ANDINAS. The participant should note that activities, schedules, itineraries, facilities and modes of transportation may be subject to modifications without prior notice, due to local circumstances or events beyond the control of RAICES ANDINAS. These may include (but are not limited to) member’s illness or mechanical breakdown, flight cancellations, strikes, events caused by political disputes, border difficulties, weather problems, and other unforeseen circumstances.

b. RAICES ANDINAS reserves the right to alter any itinerary, pledging if possible to inform the participant in writing.

c. RAICES ANDINAS is not responsible in the event that for reasons of force majeure the expedition must be suspended, modified or canceled. These reasons include (but are not limited to) strikes, blockades, war, civil unrest, government demonstrations, and natural catastrophes. However, in such circumstances, RAICES ANDINAS will endeavor to return each participant as a large part of the travel expenses, in case of cancellation before or during the trip.

7. Charges and payments.

a. Once the reservation is made, a non-refundable deposit of US $ 50 (or 50% of the total cost, which is the lowest) per participant must be sent to RAICES ANDINAS in order to confirm the reservation.

b. The balance, according to the schedule (confirmed in the final invoice), is paid at least 1 day before departure.

8. Cancellation made by the participant.

Cancellations must be advised to RAICES ANDINAS during working hours in written or verbal form. Cancellation fees will apply from the day on which RAICES ANDINAS receives a written cancellation. The cancellation conditions are expressed as a percentage of the total money paid directly to RAICES ANDINAS.

– 25% payment in advance for the reservation.
– 50% during the 15/30 days before departure.
– 75% during 4/14 days before departure.
– 100% if less than 3 business days before departure.

9. Cancellation made by RAICES ANDINAS.

The cancellation must be communicated orally or in writing to each participant. Any cancellation made by RAICES ANDINAS means a 100% refund to the participants. No compensation will be added.

10. Delay and cancellation of flights.

RAICES ANDINAS is not responsible for the delay or cancellation of flights, whether or not included in the itinerary. RAICES ANDINAS is not responsible for any damage or inconvenience that changes in flight schedules may cause to participants. However, RAICES ANDINAS will help in the organization of new departures, and will assume the obligation to inform third parties if necessary.

11. Prices and surcharges.

RAICES ANDINAS reserves the right to impose surcharges at any time in case of unfavorable movements in exchange rates, increases in transportation costs, or taxes, or if the government’s political actions compel us to do so.

12. Accuracy of information.

RAICES ANDINAS gives faith of all the information that is provided in its web page and this is correct at the time of its publication. All other information contents of third parties may be considered unreliable.

13. Complaints.

Any complaints about the aspects of the trip should be addressed in the first instance to the Tour Leader so that he / she can try to rectify the situation. Only if RAICES ANDINAS and their staff are correctly and timely informed, they could rectify any situation that gave rise to the complaint. If the matter is not resolved to the satisfaction of the participants, they must inform the Director of RAICES ANDINAS within 28 days after the end of the service provided by RAICES ANDINAS.

14. Law and Jurisdiction.

a. Any dispute or claim, of whatever nature, arising out of or in any way in connection with these Terms and Conditions, any agreement arising out of these Terms and Conditions or any breach of any of the terms set forth herein, shall be governed and interpreted according to the laws of CHILE.

b. The participant irrevocably acknowledges and accepts that the courts of CHILE shall be solely competent to resolve any controversy or claim, of whatever nature, arising or related in any way to the present Terms and Conditions or any other contract related to the expedition.
